Terms of Service

These terms take effect on the day subscriptions open.

Last updated: .

Subscriptions are not open yet. Nothing can be bought today. This page is published in advance so that it can be read before you subscribe. It takes effect when subscriptions open.

These Terms are the agreement between you and the company named in section 22 ("9to95", "we", "us") for your use of the 9to95 retirement projection service, its web app, the 9to95.com website and the instruction files we publish for AI assistants (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

9to95 is a calculator. You can use it in two ways with one subscription. You can connect your own AI assistant (for example Gemini, Claude or ChatGPT) to the Service: your assistant asks you about your household, writes a scenario (ages, balances, income, spending and assumptions) and sends it to us. Or you can sign in to our web app and enter the scenario yourself; the address of the web app will be published here when subscriptions open. Either way we run the arithmetic: a year-by-year projection and Monte Carlo simulations that include estimates of federal and state tax, Social Security, health-insurance costs, required distributions and estate figures. We send numbers back, to your assistant or to your screen, in the form of projections, simulations, comparisons of plans you define, and tables that break those results down.

2. IMPORTANT: THIS IS NOT ADVICE

Please read this section carefully. It limits what you can rely on.

The Service produces educational modeling output from the inputs you provide. It is not financial, investment, tax, legal, accounting or insurance advice, and it is not a recommendation to do or not do anything.

We are not an investment adviser, financial planner, broker, tax preparer, accountant, attorney or fiduciary, and using the Service does not create any advisory, fiduciary or professional relationship between you and us.

No one at 9to95 reviews your plan or tells you what to do with it. Support can explain how a figure was calculated.

The Service does not recommend any security, fund, product, provider or asset allocation, and it does not tell you what to buy, sell or hold. We receive no payment from any fund company, insurer, broker, adviser or other product provider, and nothing in the Service is placed or weighted for anyone's benefit. It calculates what happens in a model under the choices you enter. Where you ask it to, it can also search a range of options that you set, such as claim ages, retirement ages, spending levels or conversion amounts, and show which of them comes out highest or lowest on a measure that you choose. That is arithmetic on a model. It is not a judgment that the option is right for you, and a different measure, a different assumption or a longer or shorter life gives a different answer. Which plan is right for you depends on things the model cannot see, and the choice is yours.

Every result is hypothetical. Results are estimates under stated assumptions. They are not predictions or guarantees, and actual outcomes will differ.

Tax figures are planning estimates only. They are not a tax return, must not be used to prepare or file a return, and may differ from what you actually owe.

Where the Service shows figures for an annuity, a pension or a loan, it does arithmetic on the figures you enter. It does not examine, appraise, review or evaluate any insurance policy, annuity contract, pension plan or loan offer, names no insurer or lender, and does not say which option to take.

Before you make a financial, tax or legal decision, consider speaking with a licensed professional who can look at your whole situation.

3. Who can use the Service

You must be at least 18 years old. The Service is operated from the United States, models United States tax and benefit rules, and is intended for people who live in the United States. It is for your own personal and household planning. You may not use it to provide services to clients or to anyone outside your household.

4. Your account

You need an account, and a free trial or a paid subscription, to use the Service with your own figures. The demo described in section 8 needs neither. Give us a working email address, keep your sign-in details to yourself, and tell us at support@9to95.com if you think someone else has used your account. You are responsible for activity under your account. One sign-in works for both the AI assistant connection and the web app. Sign out of the web app on any device that other people use. Never paste a password, sign-in code or key into a conversation with your assistant. We will never ask you to.

5. Your AI assistant

Your assistant is yours, not ours. It is provided by another company under that company's terms and privacy policy. When it interviews you, writes a scenario, calls the Service and explains results, it acts for you and at your direction. It is not our agent, employee or representative, and it does not speak for us.

We do not control, see or review what your assistant says to you. We receive only the tool requests it sends and we return only numbers, warnings and a disclaimer. We publish instructions that ask assistants to present results as comparisons, to show every warning and to include our disclaimer. Assistants do not always follow instructions. An assistant can mishear you, enter a wrong figure, leave something out, misstate a result, or produce numbers the Service never calculated.

So:

  • Only figures actually returned by the Service are our output. Anything else your assistant says, including any opinion, ranking or recommendation, comes from your assistant and not from us.
  • Check the scenario your assistant wrote before you rely on any result. The inputs are yours, and a wrong input gives a wrong result.
  • Read every warning the Service returns.
  • What your assistant's provider does with your conversation is governed by its terms, not ours.

The web app. When you use the web app there is no assistant in between. What the app shows comes from us, and sections 2, 6, 16 and 17 apply to all of it. Charts, tables, labels and summaries in the app describe what the model calculated from your inputs. Where a screen marks one row of a table, it marks the row that came out highest or lowest on the measure you chose, and says so. None of it is a judgment that an option is right for you.

6. Accuracy, assumptions and data dates

We work to make the calculations correct, but we do not promise that they are. In particular:

  • Models simplify. The Service does not capture every rule, account type, state or personal circumstance. A list of what it does not cover is on our known limits page.
  • Assumptions drive results. Returns, inflation, life expectancy and spending are assumptions. Default assumptions are ours, are stated in the results, and can be changed by you. Different assumptions give different answers.
  • Reference data has a date. Tax brackets, benefit formulas, contribution limits and similar tables are written for one tax year and are updated periodically, so they can lag current law. Some data is confirmed against official sources and some is not yet fully confirmed. The tax year the tables are written for, and which state tables are only partly confirmed, are stated on our known limits page.
  • The law changes. The Service models the rules in its data. It does not predict future changes in tax or benefit law.
  • Simulations vary. Monte Carlo results change with the random seed and the number of trials. A probability shown by the Service describes the model, not your future.
  • Software has defects. If you find an error, please tell us at support@9to95.com.

7. We do not keep your scenarios

The Service is built so that your scenario is used to run a calculation, the result is delivered to you, and the scenario is then discarded. The result of a completed simulation stays in the server's memory for up to 15 minutes, identified only by a one-way fingerprint of the request, so that an identical repeat is not run or counted against your allowance twice; it is never written to disk or to a log. We cannot retrieve, resend or restore a scenario or a result.

In the web app, your plan is kept in your own browser and in any file you save to your own device, and the results of simulations the app has completed are kept in your browser too. We do not hold a copy of either. That means:

  • If you clear your browser's data, use a private window, change browser or device, or lose the device, the plan and the saved results in that browser are gone. Some browsers also remove stored website data on their own. We cannot restore them; a simulation can be run again, and section 8 says when that is not counted.
  • A plan file you save is yours to look after. Keep it safe: it is not encrypted, and anyone who has it can read it. We cannot open, repair or recover a file for you, and we do not promise that a file saved today will open in every later version of the app.
  • A report you download is built for you and then deleted from our server. Keep the copy you downloaded.
  • On a shared computer, delete the plan from the app and sign out before you leave.

You are responsible for keeping your own copy of anything you want to keep. Our Privacy Policy explains what we do keep.

8. The paid plan, prices and the demo

  • Paid plan. Using the Service with your own figures requires the paid plan, which starts with a free trial. It includes all calculator tools. It costs 89 US dollars per year or 9 US dollars per month, plus any sales tax.
  • Free trial. Each plan starts with a free trial of 7 days. To start it you choose the annual or monthly plan and give a payment card at Paddle's checkout. Nothing is charged during the trial. It includes every calculator tool, through your AI assistant and in the web app, with the lower daily allowance under "Limits on use". Unless you cancel before the trial ends, your plan starts when it ends and Paddle charges the plan's price that day: 89 US dollars for the first year of the annual plan or 9 US dollars for the first month of the monthly plan, plus any sales tax, or the price a discount code you entered sets. It then renews under section 10. The trial's end date and time are shown at checkout and in the email we send when it starts, and we email you again 2 days before it ends. You can cancel at any time during the trial as section 10 describes; you keep the trial until it ends and are never charged. There is one free trial per person: we may refuse a trial to an email address that has already had one or that has had complimentary access, and opening a second trial under other details breaks section 12. These Terms and our Privacy Policy apply during a trial. If the first charge after a trial is unwanted, ask within 30 days of it and you get it back in full under section 11; your access then ends at once.
  • No free plan. There is no free plan. If you subscribe and the Service is not for you, the 30-day refund in section 11 gets your money back.
  • Discount codes. We sometimes give out discount codes, including in online communities. You enter a code at Paddle's checkout, which shows the discounted price, the regular price that follows and when it starts. For every code:
    • it applies only to the plan and first period its terms state. For example, 50 US dollars off the first year of the annual plan means you pay 39 US dollars, plus any sales tax, for that year. If you start a free trial with a code, that year starts and is charged when the trial ends;
    • after that period your subscription renews automatically at the regular price then in effect, 89 US dollars per year today, until you cancel;
    • codes cannot be combined with each other or any other offer, and each can be used once per person;
    • each code has an end date, a use limit or both, stated where we give it out. We may end a code early only if it is misused. Ending a code never changes the price of a subscription already bought with it;
    • a code has no cash value, cannot be transferred, and cannot be applied to a past charge or reused after a refund.
  • Complimentary access. We sometimes give an account free use of the calculator for a period we choose, for example to a tester, a reviewer or someone we want to thank. Complimentary access is a gift, not a subscription and not a free trial: no card is taken, nothing is ever charged, and it does not renew. It includes the calculator tools we name when we give it, under "Limits on use". It ends on a date we set when we give it, or earlier if we end it. We do not show or announce that date and we send no reminder before it, so do not rely on complimentary access for any deadline. When it ends, the account is frozen under section 15 and the calculator is closed to it until you subscribe; we email you that day. If we give the same account complimentary access again within the 90 days in section 15, the account is restored as it was. Complimentary access carries no promise of any kind, and sections 2, 6, 16 and 17 apply to it. If you write about 9to95 anywhere public while you have it, say that your access was free.

The demo. The demo opens when the service goes live. From then, anyone can try it without an account and without paying. The demo runs only the sample households that come with it. Those households are invented and are not real people. The demo does not accept your own figures, its simulations are smaller than a standard run and preset, and each demo result includes a line pointing to the paid plan. Because the demo knows nothing about you, demo results say nothing about your situation and you must not rely on them for any decision. Sections 2, 5, 6, 16 and 17 apply to the demo. We may change or withdraw the demo at any time. The demo collects no personal information from you beyond ordinary access logs, as our Privacy Policy explains.

Limits on use. To keep the Service working for everyone, each subscription and each free trial has these limits, which apply to the AI assistant connection and the web app together:

  • a single simulation request may be at most two and a half standard runs (section 8 defines a standard run); the demo runs a smaller, preset simulation;
  • calculations share limited computing capacity. While it is busy a request waits its turn, and a long simulation may take longer while others run. If too many requests are already waiting, the newest is declined and can be tried again shortly;
  • each subscriber may use up to 25 standard simulation runs in a day, counted in Coordinated Universal Time. Our pricing page shows the same figure. A standard simulation run is the simulation the web app runs for a plan; an assistant run of the same size counts as one run, and an assistant run of a different size counts in proportion to its size. A request that simulates several plans or passes counts each one: an assistant's sensitivity request counts five runs. An identical repeat answered from memory, as section 7 describes, is not counted a second time. In the web app, an identical repeat of a seeded simulation you have already completed is not counted again at all, for as long as you have an account, because we keep a receipt for it as our Privacy Policy explains. A request that differs in any setting, including its size or its random seed, is a new simulation and is counted. The Overview screen starts a standard seeded simulation by itself when you first open a plan for which your browser holds no completed seeded result. After later changes, you choose when to run it again. That automatic run is counted like any other run, except that it is not counted if a receipt shows you have already completed the same plan with the same settings, and a result your browser already holds is reused without any request to us. The daily figure will not be lowered for you without the notice in section 20. During a free trial the daily figure is 5 standard simulation runs.

When you reach a limit, the Service declines the request and tells you which limit applied and when you can try again. A declined request is not charged, nothing extra is charged, and nothing is queued or run later without you asking. Unused allowance does not carry over. We may also apply reasonable technical limits on request size and calls per minute. We keep a count of your use to apply these limits, as our Privacy Policy explains.

Your assistant provider may charge you separately for its own product. That is between you and the provider.

9. Payment through Paddle

Our order process is run by our online reseller, Paddle (Paddle.com Market Limited and its affiliates, including Paddle.com Inc. for buyers in the United States). Paddle is the merchant of record for all paid orders. That means you buy your subscription from Paddle, Paddle charges your payment method, collects and remits any sales tax, and handles billing questions, refunds and payment disputes. Paddle's Buyer Terms and privacy policy apply to the purchase. These Terms govern your use of the Service itself. We never receive your full card number.

10. Automatic renewal and cancellation

Paid subscriptions renew automatically. An annual subscription renews every year, and a monthly subscription renews every month, at the price then in effect for your plan, until you cancel. A free trial becomes a paid subscription automatically when it ends, unless you cancel before then (section 8). A free trial converts at the price shown when you started it. If your first period was discounted with a code, the first renewal is at the regular price.

  • How to cancel. You can cancel at any time, online, in Paddle's customer portal. Reach it from the link in your Paddle receipt or from the link in any reminder we send you. The direct portal link will be listed here when subscriptions open. You can also cancel by email: write to support@9to95.com from your account email address and say "cancel". A ready-made cancellation email is on our support page at https://9to95.com/support.html. No phone call and no reason are needed.
  • When to cancel. To avoid the next charge, cancel before the renewal date shown in your receipt, in our confirmation email and in Paddle's customer portal. An emailed request counts from the time you send it. During a free trial, cancel before its end date and time, shown at checkout and in our emails, and you will not be charged.
  • What happens. Cancelling stops future charges. You keep access until the end of the period you already paid for. If you cancel during a free trial, you keep the trial until it ends and nothing is charged. After that your access to the Service ends, because there is no free plan. Your account is then frozen and is deleted 90 days later, as section 15 explains. You can subscribe again at any time at the price then offered. We will email you a confirmation.
  • Reminders. During a free trial we will email you 2 days before it ends, with the date and amount of the first charge and a link to cancel. For annual subscriptions we will email you between 30 and 40 days before each renewal, with the amount and a link to cancel. If your first year was discounted with a code, we will also email you between 7 and 21 days before the first renewal, stating when the discounted price ends, the regular price and how to cancel. For monthly subscriptions we will email you once a year, between 30 and 40 days before the renewal that takes your subscription past each 12 months, with the amount, how often you are charged and a link to cancel.
  • Price changes. We may change the price of any plan. These rules apply to every price change:
    • A new price never applies in the middle of a period you have already paid for. It applies only from a renewal.
    • Annual plan. A new price takes effect at your next annual renewal, and only if we emailed you at least 30 days before that renewal. If we give you less notice than that, that renewal is at your old price.
    • Monthly plan. A new price takes effect at the first monthly renewal that falls at least 30 days after we emailed you.
    • The email will state your current price, the new price, the date the new price takes effect and how to cancel. We will also send a second notice between 7 and 30 days before the new price takes effect.
    • You do not have to accept a new price. Cancel before the renewal at which it takes effect and you will not be charged it. If you do not cancel, your subscription renews at the new price.
    • If you are charged a higher price than at your last renewal and decide you do not want it, ask within 30 days of that charge and you will get that charge back in full.

11. Refunds

If you are not satisfied, ask for a refund within 30 days of a charge and you will get that charge back in full. This applies to your first payment and to any renewal payment. Refunds are issued by Paddle to your original payment method. A refund ends your subscription, and your access to the Service ends immediately when the refund is issued. See our Refund Policy at https://9to95.com/refund.html for the steps. We may decline repeated refund requests that show a pattern of abuse. Nothing in these Terms limits refund or cancellation rights that the law of your home state gives you.

12. Acceptable use

You agree not to:

  • use the Service for anyone outside your household, resell it, or use it to give advice or services to others;
  • present the Service's output to anyone as advice from us, or as a recommendation, endorsement or guarantee;
  • share your account or sign-in, open more than one free trial, or get around usage limits, the limits of the demo or of a trial, or access controls;
  • probe, scan or attack the Service, disrupt it, or send it harmful code;
  • copy, scrape or reverse engineer the Service, except where the law gives you that right regardless of contract;
  • use scripts, bots or other automated means to operate the web app, or to get around the limits in section 8;
  • load the web app's code or screens into another site or product;
  • send another person's personal information without their permission, other than members of your household whose finances are part of your plan;
  • use the Service to break the law.

Do not send us information the Service does not need, such as account numbers, Social Security numbers or passwords.

13. Ownership and feedback

We own the Service, including the software, the reference data as we have compiled it, the instruction files and the 9to95 name. While you follow these Terms, you may use the Service, and let your assistant use the instruction files, for your own household planning. Your scenarios and your results are yours. If you send us suggestions, we may use them without owing you anything.

14. Privacy

Our Privacy Policy explains what we collect and what we never store. It is part of these Terms.

15. Availability, changes, suspension and closing your account

We try to keep the Service available but do not promise that it will be uninterrupted. A calculation, or part of one, may run on more than one computer. If the computers that run simulations are busy or not working, a simulation may be declined with a request to try again later. A declined simulation is not counted against your daily allowance, and projections are not affected. We may change, add or remove features. If we remove a paid feature that matters to you, or if we stop offering the Service, you may cancel and we will refund the unused part of the period you paid for.

We may suspend or close an account that breaks these Terms, puts the Service or other users at risk, or is the subject of a payment dispute. If we close a paid account for a reason other than your breach, we will refund the unused part of the paid period. You may close your account at any time by emailing support@9to95.com. Closing an account does not by itself cancel a subscription. Cancel the subscription first, as described in section 10.

Accounts without a subscription. When your subscription ends, whether by cancellation at the end of the paid period or of a free trial, by refund, or because a payment failed, or when complimentary access under section 8 ends, your account is frozen: it cannot be used and we do nothing with it. We delete a frozen account 90 days after the day your access ended. An account that never starts a trial or subscription is deleted 90 days after the day it was created, or, for an account that existed before this rule took effect, 90 days after the day it took effect. If you want it deleted sooner, email support@9to95.com. Our Privacy Policy explains the records we keep after deletion, and how soon backup copies expire.

16. NO WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ITS RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, ERROR-FREE OR UNINTERRUPTED.

WE MAKE NO WARRANTY ABOUT YOUR AI ASSISTANT OR ANYTHING IT SAYS OR DOES.

Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you. Our 30-day refund in section 11 is a promise we do make.

17. LIMIT OF LIABILITY

TO THE FULLEST EXTENT THE LAW ALLOWS:

(A) WE ARE NOT LIABLE FOR ANY DECISION YOU MAKE OR ACTION YOU TAKE OR DO NOT TAKE BASED ON THE SERVICE'S OUTPUT OR ON ANYTHING YOUR AI ASSISTANT SAYS, OR FOR ANY INVESTMENT LOSS, TAX, PENALTY, INTEREST, LOST BENEFIT OR LOST OPPORTUNITY THAT RESULTS.

(B) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS OR LOST DATA.

(C) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (1) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM AND (2) 100 US DOLLARS.

(D) THESE LIMITS ALSO PROTECT OUR OWNERS, EMPLOYEES AND CONTRACTORS. YOU AGREE TO BRING ANY CLAIM ABOUT THE SERVICE AGAINST THE COMPANY NAMED IN SECTION 22 AND NOT AGAINST ANY INDIVIDUAL.

These limits apply to every kind of claim, whether in contract, negligence or otherwise, and even if a remedy fails. They do not apply to liability that cannot be limited by law, including liability for our gross negligence, intentional misconduct or fraud. Some states do not allow some of these limits, so parts of this section may not apply to you.

You agree that these limits are a fair allocation of risk for a low-cost calculator, and that we could not offer the Service at this price without them.

18. Misuse

If you use the Service for someone outside your household or otherwise in breach of section 12, and that person or anyone else brings a claim against us because of it, you will reimburse our reasonable costs and losses from that claim.

19. Governing law and disputes

Talk to us first. Most problems can be fixed by email. Before starting a legal claim, write to support@9to95.com and describe the problem and what you want. We will try to resolve it within 30 days.

Governing law. New York law governs these Terms and any dispute about the Service, without regard to its conflict-of-laws rules. If you live in another state, you keep any consumer protections of your home state that cannot be waived by contract.

Where claims are heard. Any claim that is not resolved informally must be brought in the state or federal courts located in Queens County, New York, and you and we consent to those courts. As an exception, either of us may bring a qualifying claim in small claims court in Queens County, New York or in the county where you live.

Individual claims only. To the extent the law allows, you and we will each bring claims only on our own behalf, and not as a plaintiff or class member in any class, collective or representative proceeding.

No jury. To the extent the law allows, you and we each give up the right to a jury trial.

Time limit. Where the law allows, a claim must be filed within one year after it arose. If the law of your state gives you longer and does not allow that time to be shortened, that law applies.

20. Changes to these Terms

We may update these Terms. We record the version you accepted when you created your account. If a change is material, we will email you and post the new Terms at least 30 days before the change takes effect. If you have a paid subscription, a material change will not apply to you before your next renewal unless you accept it sooner. If you do not agree to a change, cancel before it takes effect. If you cancel for that reason, we will refund the unused part of the period you paid for. Continuing to use the Service after a change takes effect means you accept it.

21. General

  • Electronic communications. You agree that we may send you notices about your account and these Terms by email to your account address, and that these electronic notices satisfy any requirement that a notice be in writing. Keep your email address current.
  • Whole agreement. These Terms, the Privacy Policy and the Refund Policy are the whole agreement between you and us about the Service. Paddle's Buyer Terms separately govern your purchase from Paddle.
  • If part is unenforceable. If a court finds part of these Terms unenforceable, the rest stays in effect.
  • No waiver. If we do not enforce a term, we have not given it up.
  • Transfer. You may not transfer your account or these Terms. We may transfer them to a successor that takes over the Service and agrees to honor them.
  • What survives. Sections 2, 5, 6, 7, 13 and 16 to 21 continue to apply after your account closes.
  • Offered in the United States. The Service is offered only to people who live in the United States, and we do not accept orders from elsewhere.

22. Who we are and how to contact us

The Service is operated by, and these Terms are an agreement with:
